Fatwa number ( 15761 )
Q: I have a brother from my mother. I had workers and built him a single-story house. When we settled the accounts, I was left with about fifty-five thousand riyals from his side, and the remaining amount was actually more than that. He asked me to reduce the amount, so I reduced it by twenty thousand riyals, leaving him with thirty-five thousand riyals. After a year passed, I asked him for the amount, and he said to me: "You have no amount owed to you." I know that there are witnesses and a document regarding this. So I said: "Your house is forbidden for me to enter, just as my mother is forbidden to me," and I said this while I was extremely angry with him when he told me: "You have no amount owed to you."
I know that I visit him at his workshop and his financial situation is very good. I am not demanding the amount from him now, and I will not demand it, but I want to free myself from this predicament I am in regarding this prohibition. I ask Allah, then you, to give me the solution. I repeat that I said this while I was extremely angry. May Allah preserve you.
A: It is obligatory for you, regarding what you mentioned, to pay the expiation for an oath, which is: freeing a slave, or feeding ten poor people, with each poor person receiving half a sa' of food, approximately one and a half kilograms, for each one, or clothing ten poor people, with each poor person receiving a garment. If you do not find any of what is mentioned, then you fast for three days. There is no harm in your entering your brother's house after that, and you may pay the expiation before entering or after. And Allah knows best. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
