Fatwa number ( 16242 )
Q: I seek a fatwa from your Eminence regarding my undertaking of a journey from a region over a distance of 240 km. I broke my fast, and on the second day, I had intercourse with my wife and stayed with my relatives for a period of 3 days, and my intention was to travel at any time during those three days , and I broke my fast. I ask your Eminence to issue a ruling to us regarding intercourse in Ramadan, even though the intention was during a journey from one region to another over a distance of 250 km, and from the country of Saudi Arabia to the country of Syria , where I traveled to Sham for the purpose of treatment and returned to my home. My intention was to fast, but I had intercourse with my wife and broke my fast. This was another day, meaning I broke my fast for two days.
This, and may Allah preserve you?
A: Intercourse during a journey does not require expiation; because it is permissible for the traveler to break his fast during the journey through intercourse and other things that Allah has made permissible for him. However, it is obligatory to make up the day that you broke your fast; due to the saying of Allah, the Exalted:[Al-Baqarah 2:185] . Your wife is like you in the ruling if she was traveling with you. And after returning to your country, fasting is obligatory upon you due to the end of the journey. As for intercourse after returning to your country, you must repent to Allah, the Exalted, and make up the day in which you had intercourse, and you must perform the expiation, which is: freeing a believing slave. If you do not find one, then fast for two consecutive months. If you are unable to do so, then feed sixty poor people. And your wife is required to do the same. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
