Fatwa number ( 16788 )
Q: A man traveled to Makkah al-Mukarramah , and returned to his residence in the Eastern Region while not fasting, and after returning and entering his home, he had intercourse with his wife during the day of Ramadan , knowing that he was unaware of the ruling, and his wife asked him, fearing that
there might be a prohibition in the matter, so he said to her: If Allah wills, there is no harm in it, but the matter weighed on his mind, so he desires the ruling, and if there is a prohibition, what is the expiation?

A: It is obligatory for each of you to perform an expiation, which is: freeing a believing slave for each of you, if you do not find one, then each of you must fast two consecutive months, if you cannot do so or one of you cannot, then feeding sixty poor people for the one who cannot fast, and it is obligatory for both of you to make up the day in which the intercourse occurred, along with feeding one poor person for whoever delays making up the day until after another Ramadan. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
