Q: I traveled to Egypt by land in a bus for three days. I broke my fast on these days on the basis that I was a traveler, and that I would make them up on other days. And when I arrived in Egypt , at my house at midday, I had intercourse with my fasting wife , knowing that she initially refused, and when I told her that we would make it up, if Allah wills, on another day, she agreed. Knowing that when I persuaded my wife to break her fast, I did not know that there would be an expiation, and I thought that she would only have to make up the day, like the ruling for a traveler or a sick person,
I want to know the ruling of the religion regarding this day, and whether the expiation is on me or only on my wife? And on the same day at night, at one o’clock in the evening, I had intercourse with my wife, and we went to bed to rest a little and prepare for the pre-dawn meal. We intended to fast for the second day, but we found ourselves in the morning without having performed the full ritual bath and without having eaten the pre-dawn meal. We woke up in the morning at 11 before midday, and I was feeling extreme fatigue from the travel, so we also broke our fast on this day. Do we have an expiation for this day? And is the expiation for both days together, or does each day have one expiation? And if there is an expiation on both of us, and the expiation is as I read in the Book of Allah the Exalted, fasting two consecutive months, we are unable to fast, so what is the alternative for that? May Allah reward you all with good.

A: Not performing the full ritual bath from major ritual impurity does not prevent the establishment of the fast, and likewise, not eating the pre-dawn meal does not prevent that. It was obligatory for you both to proceed with the fast that you intended from the night. So what you did was an error, and each of you must make up the two days mentioned, and feed a poor person for each day for the delay in making up the fast, if another Ramadan has come after it. And each of you also has the expiation for intercourse during the day in Ramadan, which is: freeing a slave, so whoever does not find one, then fasting two consecutive months, so whoever
is unable to do that, then feeding sixty poor people, along with repentance to Allah, and not returning to such an act. And you both also have a second expiation if you had intercourse with her on the second day that you did not fast, along with repentance to Allah the Exalted from both of you, if that was in the month of Ramadan. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
