Q: I was traveling during Ramadan, and I broke my fast while on my journey. When I arrived home from my trip, I met my wife, who was fasting during the day of Ramadan, and I had intercourse with her while she was fasting . Please note that she was willing, but she was ignorant of the ruling because she could neither read nor write. I assumed that making up one day would suffice for that. Please note that a short time has passed since this occurred. She wanted to fast two consecutive months without asking anyone, but she was only able to fast fifteen days. I ask you to inform me of what is required of me and of her. May Allah guide you.
A: You must pay the expiation according to your ability, which is: freeing a slave. If you cannot do that, you must fast two consecutive months. If you cannot do that, you must feed sixty poor people, giving each poor person half a sa' (a dry measure of about 3 kg) of wheat, rice, or other staple food of the country;
because as soon as you arrived in the town, you were required to abstain from food and drink, and the rulings of fasting became obligatory upon you. Likewise, your wife is required to pay the same expiation as you, and she must also make up the fast for the day on which the intercourse occurred, along with the expiation. The expiation is feeding a poor person if she has not made up the fast until another Ramadan has passed. You both must repent to Allah for this act and not return to it. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
