Q: I married in the early days of my youth, around the year 1369 AH, and I was living in a valley cut off from water. Ramadan of the year 1369 AH came upon us, and after we had fasted for two or three days in the month, I intended to break the fast, as did my wife, on the fourth or fifth day of Ramadan. We broke our fast and I had intercourse with her while I was not fasting and she was not fasting; because we were ignorant and did not know any hadith, except that we heard from some people that a day is made up for a day. So we broke our fast, and after that we made up that day. I am asking you, Your Eminence, to inform me and my wife of what you see as a fatwa or expiation for this day. May Allah protect you.
A: It is obligatory for you and your wife to repent; because breaking the fast in Ramadan without a valid Islamic excuse is one of the major sins, and each of you owes the expiation,
which is: freeing a believing slave. If he does not find one, he must fast for two consecutive months. If he is unable to do so, he must feed sixty poor people. As for making up the day, you mentioned that each of you fasted one day to make it up, and that is sufficient. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
