Fatwa number ( 15637 )
Q: Indeed,I had intercourse with my wife in the blessed month of Ramadanin the year 1403 AH, twice in that month, and also in the year 1407 AH, once. I have made up those days after the end of each month, but I have not performed the expiation for those scattered days, as I work in an area far from the city where I live, which lacks electricity services and has difficult roads, and I am unable to fast two consecutive months. I ask you, Your Eminence, to provide the appropriate solution and answer. Is it permissible for me to expiate each day by feeding sixty poor people, or to expiate for those days at once by feeding sixty poor people, since they are scattered? Also, what is the amount of the expiation in Saudi Riyals? And is it permissible to pay the expiation through acts of righteousness, such as building a mosque or building a house for some of the poor? I ask you to write the answer and solution, and may Allah reward you for Islam and the Muslims, for He is the All-Hearing, the Responsive, and thank you.
A: If the matter is as you described, it is obligatory for you, in addition to making up the three days, to repent and seek forgiveness, and to perform three expiations; because the intercourse occurred on days
that were scattered. The expiation is: freeing a believing slave. If you do not find one, then fast two consecutive months. If you are unable to do so due to illness, old age, or hardship that you cannot bear and which prevents you from fasting, then feed sixty poor people for the intercourse of each day. Each poor person is given half a sa' (a dry measure of about 3 kg), which is approximately one and a half kilograms by weight of the staple food of the country, such as barley, rice, or other similar items. It is not permissible to spend the value of the expiation on charitable works or building mosques, and it is not permissible to pay it in cash. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
