Q6: A man had intercourse with his wife (his spouse) in Ramadan, and after the ruling from the scholars, he did not find a slave to free and was unable to fast, so feeding remained. Three years have passed since then. Is there a sin on him for the delay, and does he owe an expiation?
A6: If a man has intercourse with his wife during the day in Ramadan, it is obligatory for him, along with making up the fast, to perform the expiation, which is freeing a believing slave. If he is unable to do so or cannot find one, he must fast for two consecutive months, sixty days. If he is unable to do so due to old age, illness, or the like, he must feed sixty poor people. It is incumbent upon the one who owes an expiation to hasten to perform it and to clear his conscience of it. If one delays it without an excuse, he must repent for that and hasten to fulfill it, and there is no expiation for the delay other than performing it. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
