The question: This is a letter received from (H. R. D. al-Harbi) from al-Hawiyyah in al-Ta'if. He says in his letter: About four years ago, I had intercourse with my wife on one of the days of Ramadan. At that time, I was ignorant of the ruling, and afterwards I learned, praise be to Allah, and I realized that this is not permissible in Ramadan. So my question is: What is the expiation that I must perform, knowing that I have repented to Allah ?
The answer: The one who has intercourse with his wife in Ramadan must repent to Allah , and he must perform the expiation. The expiation is: freeing a believing slave. If he cannot do that, he must fast for two consecutive months. If he is unable to do that, he must feed sixty poor people, which is thirty sa' (a dry measure of about 3 kg), with each sa' divided between two people. This is what is obligatory for the one who has intercourse with his wife in Ramadan. If he is unable to fast or feed them, it is dropped from him due to his poverty and severe need. As long as he is able, he expiates with one of these three:
First: freeing a slave, meaning: a believing slave whom he frees if he is able. If he is unable, he fasts for two consecutive months. If he is unable to do that, he feeds sixty poor people, giving each poor person half a sa' of dates, rice, or wheat, meaning: the staple food of the country.
