Fatwa number ( 16797 )
Q: I performed Hajj in the year 1414 AH, as I came to Makkah and performed tawaf seven times, which was the arrival tawaf. After that, I performed sa'y for only one lap and did not complete the rest, because I was with elderly women who were unable to complete the rest. After that, we went to Mina and stayed in Mina until the Day of Tarwiyah, that is, the eighth day. After that, we proceeded to 'Arafah after the sun rose on the ninth day, and we stayed in 'Arafah until before the sun set.
Then we went from 'Arafah to Muzdalifah before the sun set, and stayed overnight in Muzdalifah . Then I went to Mina , and they entrusted me with stoning the first pillar. I performed the stoning in the middle of the night on the night of the festival. In the morning, we slaughtered the sacrificial animal. Then we went to the Haram and performed tawaf seven times, but we only performed sa'y for two laps . On the second day, I stoned the pillars at ten in the morning. On the third day, I stoned in the middle of the night. After that, we went to the Haram and performed the farewell tawaf for seven complete laps, but we only performed sa'y for one lap. Please issue a ruling on what is obligatory for me, and may Allah reward you with good.
A : If the matter is as you described, then you must return to Makkah and perform sa'y between al-Safa and al-Marwah for seven laps, which is the sa'y of Hajj. If intercourse occurred during this period, then the one who engaged in it must slaughter a sheep in Makkah and distribute it among the poor of the Haram. Also, each of you must pay a fidyah (ransom payment) for leaving 'Arafah before the sun set. Likewise, each of you must pay a fidyah for the stoning that took place before noon, because it is not valid. All these fidyah are slaughtered in Makkah and distributed to the poor. Whoever is unable to pay the fidyah must fast for ten days for each fidyah. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
