The first question of Fatwa No. ( 16415 )
Q1: We performed Hajj last year, 1412 AH, and we stoned the pillars on the Day of Sacrifice. Then we exited the state of ihram after the tawaf, and on the evening of the tenth of Dhul-Hijjah we stayed in Mina and stoned the pillars for the second day after the sun passed its zenith. Then we appointed someone to stone the pillars for us on the third day. After the 'Asr prayer, we performed the farewell tawaf, and then we left Makkah after midnight on the second day. What is the ruling on our actions? Are we considered to be in the category of those who hasten to leave, or not?
A1 : You made a mistake in this action and did not complete the rituals of your Hajj, for you left three obligatory acts of Hajj. This is because you left off staying overnight in Mina on the night of the twelfth, and you appointed someone to stone the pillars on the twelfth, which is not permissible for you, because you are strong and capable of stoning. On this basis, it is obligatory
for each of you to offer three expiations, meaning: to slaughter three sheep, each of which is sufficient as an 'Id sacrifice, in Makkah and distribute them to its poor, and not to eat any of them. One is for leaving off staying overnight in Mina on the night of the twelfth, the second is for leaving off stoning the pillars yourselves when you were capable of it, and the third is for the farewell tawaf, because you performed it before its proper time, so it does not suffice. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
