The first question of Fatwa number ( 16126 )
Q1: We performed Hajj and did not find a place to stay in Mina and we stayed in South of the Valley between Muzdalifah and the Valley , and likewise on the night of the festival we sat in Muzdalifah until the moon set, then we walked and stoned the pillars and performed the circumambulation before the call to the dawn prayer. Is there any defect in our Hajj?
A1 : If the situation is as described in the question, then the Hajj is valid, if Allah wills, and staying outside Mina is permissible for those who are unable to stay in it; due to the saying of Allah the Exalted:
So fear Allah as much as you are ableفَاتَّقُوا اللَّهَ مَا اسْتَطَعْتُمْ
[At-Taghabun 64:16]
, and departing from Muzdalifah after the middle of the night is also permissible for the weak and those in their category. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
