The Expiation Due to Doubt

Machine translationRead the Arabic original
Fatwa No. ( 15151 )
Q: I performed the obligatory Hajj this year for the first time. I entered the state of ihram as an individual
from the Miqat of al-Qarn , wore the ihram garments, recited the talbiyah, and arrived in Makkah . I performed tawaf al-qudum seven times and prayed the two rak'ahs of the tawaf sunnah near the Maqam Ibrahim . Then I performed sa'y seven times between al-Safa and al-Marwah . After that, I headed to Mina to spend the night of 'Arafah . On the ninth day, I stood at 'Arafah from sunrise until after sunset, and I combined the Zuhr and 'Asr prayers by advancing them. Then I left 'Arafah and went to Muzdalifah , where I combined the Maghrib and 'Isha' prayers by delaying them, and I stayed until I prayed Fajr. I supplicated to Allah at the Mash'ar al-Haram . Then I stoned the Jamarat al-Aqabah after the sun rose on the Day of Sacrifice, and I shortened my hair. Then I headed to Makkah , where I performed tawaf al-ifadah. I was in a state of extreme fatigue and exhaustion. Because I suffer from high blood pressure, I performed the tawaf on the upper level due to the heavy crowds. After two circuits, I went and rented a wheelchair and completed the remaining circuits. After finishing the tawaf, I collapsed on the ground from the intensity of the fatigue and exhaustion, and I was unable to pray the two rak'ahs of the tawaf sunnah. I remained lying down and did not regain consciousness until the adhan for Maghrib, when I performed wudu and prayed. Then I prayed 'Isha' while sitting. While moving in the wheelchair, I sometimes warned the inattentive people with the stick in my hand or with a low voice so that the wheels of the wheelchair would not hurt them. I drank water twice. Is there any harm in that? After that, I headed to Mina , where I spent the night of
the eleventh, and the night of the twelfth of Dhu al-Hijjah. I stoned the three pillars, starting with the small one, on the second and third days of the festival, after the sun passed its zenith and before sunset. However, I am not fully certain that the pebbles I threw fell into the designated basin. So I threw more than seven pebbles . On the third day of the festival, after stoning the pillars, I headed to Makkah and entered the Haram , which was at the peak of its crowding on all its levels. In addition to my high blood pressure, I suffered from severe skin abrasions on my thighs, which made walking difficult for me, until it felt as if burning iron rods were running through my thighs. I was unable to perform tawaf al-wada' . Also, because I had a flight booked for a specific time earlier that same day. I heard that tawaf al-wada' is a sunnah according to the Maliki school, an obligatory act that is compensated with a sacrifice according to the other Imams, and an obligatory act that is not compensated by anything according to some others. The question is: Is my Hajj valid, or what? Please answer me, may Allah reward you, and may you have the reward and recompense.

A : You owe an expiation due to your doubt about whether the pebbles you threw fell into the basin or not. You also owe another expiation for leaving tawaf al-wada'. The expiation is a sheep that is acceptable as an 'Id sacrifice, slaughtered in Makkah and fed to the poor of the Haram. If you do not find one, fast for ten days for each expiation.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
