Fatwa number ( 20978 )
Q: A man and three of his neighbors performed Hajj, and each of them was with his mother. On the eighth day, they were in Mina looking for a place to stay. They had their tents and everything they needed with them, and they spent the whole day searching but could not find a place to set up their tents. Since they had women with them who needed a bathroom facility near the tent, but in some places they found people preventing them, they stayed in their car until the next day. They then headed to 'Arafah and stayed there for the day until
sunset, but they were unable to move with the first wave of the crowd. They waited until the crowd thinned out because of the elderly people with them, and they did not leave the boundaries of 'Arafah until shortly before midnight. They passed through Muzdalifah but did not stay overnight there because of the elderly people with them. They continued their journey and arrived at Mina as the Fajr adhan was being called. They stoned the Jamarat and headed to Makkah . After returning from Makkah , they could not find a place to stay. They continued searching, and after they were exhausted and worn out by sleep, they sat outside the marker on the side of Makkah . However, the place was not connected to the tents; rather, it was about three kilometers away from them. They sat in that place and continued to complete the rites, but they did not know that it is obligatory for them to spend most of the night in Mina , even if they did not find a place there. Also, some of the women and some of the men fell ill. Question: What is required of them regarding not staying overnight in Muzdalifah , and what is required of them regarding not staying overnight in Mina on the days of Tashriq , given the circumstances mentioned? And what about their prayer of Maghrib and 'Isha' while they were still within the boundaries of 'Arafah , shortly before midnight?
A : If the situation is as described in the question, then there is no blame on the people mentioned, and their Hajj is valid, if Allah wills. The obligation to stay overnight in Muzdalifah is dropped from them; because they did not reach it until after midnight, and they moved from it in accordance with the dispensation for the weak and those who care for them, moving from Muzdalifah after midnight. And there is nothing
required of them either regarding their staying outside Mina on the days of Tashriq; because they did not find a place in it after searching. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
