Q: I performed Hajj in the year 1411 AH, and I slept on the first night of the nights of Tashriq at the edge of the mountain located east of King Abdulaziz Bridge on the southern side, among many pilgrims whom I found sleeping in that place. On the second day of the days of Tashriq, I asked a pilgrim and informed him of the place where I had slept, and he said: This is outside Mina . He said to me: Is this your first Hajj or a voluntary one? I told him: It is voluntary, as I had previously performed the obligatory one. He said: If Allah wills, there is nothing upon you. I slept with him in the Hawd coffee shop on the second night
of the nights of Tashriq. The question: Does this invalidate the Hajj or not? And if there is an expiation upon him, is it obligatory for me to perform it at my home now, or must it be in another place? I ask for your information. May Allah reward you with all good, and peace be upon you and the mercy of Allah

A : It is obligatory for one who performs Hajj, whether obligatory or voluntary, to stay overnight on the nights of the days of Tashriq in Mina . Therefore, it is obligatory for you to pay a fidyah (ransom payment) for leaving the overnight stay in Mina , to compensate for the ritual. The fidyah is: a sheep that is acceptable as an udhiyah (Id sacrifice), slaughtered in Makkah and distributed to the poor of the Haram. If you do not find one, fast for ten days. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
