The fourth question of Fatwa No. ( 14768 )
Q4: A woman experienced postpartum bleeding after she had entered the state of ihram for Hajj and 'Umrah combined, and the bleeding continued with her for forty days, meaning it did not end until the month of Muharram. She performed all the rites of Hajj except for the tawaf and sa'y , and afterwards she was compelled
to return to her home country, Egypt, due to the work circumstances of her husband, who was with her in ihram. After the postpartum bleeding ended, some of the imams of the mosques issued a ruling for her to renew her ihram because she had passed the miqat. So she renewed her ihram, went to Makkah , and performed tawaf and sa'y for Hajj and 'Umrah, then she performed the tawaf of ifadah, and this was in the month of Muharram. Is her Hajj valid, or does she owe anything? Another woman did the same thing, except that she was going to Jizan , her place of residence, and her postpartum bleeding had ended in the month of Dhul-Hijjah. So she performed her tawaf, sa'y, and ifadah in Dhul-Hijjah, and the rest of the circumstances that happened to the first woman are the same as those that happened to the second woman. Is her Hajj valid, or does she owe anything?
A4: If the tawaf and sa'y of Hajj for the two women were after the purity from postpartum bleeding, and her husband did not have intercourse with her before the tawaf, then her tawaf is valid and she owes nothing. If intercourse took place before the tawaf, it is obligatory for her to pay a fidyah, which is a sheep that is acceptable as an 'Id sacrifice, to be slaughtered in Makkah and distributed to the poor of the Haram . And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
