Q: Please inform us, may Allah reward you. I work in housing pilgrims and those performing 'Umrah. We rent the building from the owner for one million riyals, which we pay in full. Then we house people in it during Ramadan and Hajj, while for the rest of the year, occupancy is negligible; because 'Umrah pilgrims are dependent on visas from the embassy, which are not issued during the first three months of the year, nor during the month of Shawwal, nor during the first half of Dhul-Qa'dah. There are no residents at all during these months. In any case, may Allah reward you, we pay the salaries of workers and employees throughout the year, and we pay for water by tanker trucks throughout the year, approximately (300 days' worth). During Hajj, the cost of a tanker is three times as much. We also pay for electricity and telephone bills, and for repainting the building every year. The point is that we do not receive any profits except in the range of 8% or 10% of the rental value. So we ask you, by Allah, is zakah due on us, or on the owner of the building who receives his full share in one day? Please inform us, may Allah reward you, as we have no reference in Islamic jurisprudence other than turning to your eminence and your fatwa. May Allah keep you well and prolong your life.
A: The seasonal or non-seasonal wages you receive for the aforementioned building throughout the year are to be added to the funds you possess, and their zakah is to be paid along with the zakah of your wealth when the lunar year is completed; because it is considered part of the profit of your wealth, and profit is added to the principal for the purpose of zakah. As for the rent that the owner of the building receives in full at the time of the contract, he must pay zakah on it when the lunar year has passed on the amount available to him, provided it reaches the nisab. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
