Fatwa number ( 17229 )
Q: My father, my mother, my brother, and I performed 'Umrah in Ramadan about fourteen years ago. When we went around the Sacred House and completed three circuits, my brother said that we had completed the tawaf, while my father and I said that we still had four circuits remaining. After that, we left and went to our homes, having performed only three circuits, and we completed the water of Zamzam and the sa'y, and we returned . Please rule on this: do we owe a fidyah or anything else in this matter? My father and mother have passed away, and only my brother and I remain. Is our 'Umrah valid, or is it deficient? Please explain to us what is obligatory for us and what is obligatory for the deceased. Do we have to repeat the 'Umrah by entering ihram once, or must each individual return and enter ihram anew? We are far from the Haram and are working people. If we owe a fidyah, is it permissible to give it to Al-Rajhi Bank in Sarat 'Ubaidah , which is an Islamic bank, so that they can act on our behalf, like the fidyah for Hajj? Or are we required to go to the Haram and slaughter the fidyah? Please rule on this in detail. May Allah reward you with good.
A: As for you and your brother, you are required to renew your clothing for ihram and perform the rites of the previous 'Umrah, including tawaf, sa'y, and shaving or cutting the hair.
Each of you must slaughter an animal that is acceptable as an 'Id sacrifice if intercourse occurred between you during the period mentioned. You must also enter ihram for a new 'Umrah from the miqat from which you entered ihram for the first 'Umrah, if intercourse occurred; because the first 'Umrah became invalid due to it, and it became obligatory to complete it and make it up. As for the two deceased, nothing is required of them, and whoever performs Hajj or 'Umrah on their behalf will be rewarded, if Allah wills. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
