Q4: A – I am traveling to the city of Jeddah and I wish to perform 'Umrah, and I am thinking about performing it while I am in Riyadh , and I say: if I arrive in Jeddah and I have time, I will perform 'Umrah, and if I arrive in Jeddah I will not intend to perform 'Umrah, and my brother suggests that we take an 'Umrah, I was confused about the intention and the 'Umrah and its absence, is it permissible for me to enter the state of ihram from Jeddah if I intend to perform 'Umrah, or is it necessary to be at the miqat ? B – I reside in Riyadh and I traveled to Abha , and I continued the journey from Abha to Jeddah , and upon arriving in Jeddah and after two days of arrival I went to the miqat of al-Sail al-Kabir , and I entered the state of ihram and performed 'Umrah, is my action correct? And my brother resided in Jeddah and he entered the state of ihram with me from the miqat for 'Umrah and we performed 'Umrah, is his 'Umrah valid? Knowing that he is from the people of Jeddah and he passed by Makkah
A : If you intended to perform 'Umrah while you were in Riyadh , then you went to Jeddah for some of your affairs without entering the state of ihram, then it is obligatory for you to enter the state of ihram from al-Sail al-Kabir if you resolve to perform 'Umrah, and it is not permissible for you to enter the state of ihram from Jeddah in this case; because al-Sail al-Kabir is the recognized miqat in your case, but if you were hesitant about performing 'Umrah while you were in Riyadh and you did not know if it would be facilitated for you or not, and you did not resolve the intention of 'Umrah except from Jeddah , then you enter the state of ihram from Jeddah , but if you traveled from Riyadh to Abha then you continued the journey to Jeddah and you wanted to perform 'Umrah, then
if you came via the coast, then your miqat is the miqat of the people of Yemen Yalamlam , if you passed it without entering the state of ihram, then it is obligatory for you to pay a fidyah that is sufficient for a sacrificial animal, distributed among the poor of the Haram , and if you came via the road of Ta'if , then you enter the state of ihram from al-Sail al-Kabir or from Wadi Mahram , so if you were in that situation, then what you did of entering the state of ihram from al-Sail al-Kabir is what is obligatory for you; for what is authentic from the Prophet (peace and blessings be upon him) regarding the spatial miqats, he said:
these Mawaqit are for those living at those very places, and besides them for those who come through those placesهن لهن ولمن أتى عليهن من غير أهلهن

As for your brother who resides in Jeddah , he has the ruling of the people of Jeddah , and he has the right to enter the state of ihram from Jeddah and where he went with you to al-Sail al-Kabir and entered the state of ihram from it with you, that is sufficient for him, and he owes nothing due to the generality of the previous hadith. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
