Q: What is the ruling on one who came to Makkah during the time of Hajj, and the opportunity for Hajj was available to him, but he did not form the intention from the country he came from? Is it permissible for him to perform Hajj?
A : One who came to Makkah for work or a visit or the like, then intended to perform Hajj after arriving in Makkah , is permitted to enter the state of ihram for Hajj from the place where he formed the intention for Hajj, even if that place is in Makkah itself. However, if he intended to perform Hajj in his home country, then entered Makkah during the months of Hajj without entering the state of ihram for Hajj, he is obligated to return to the miqat he passed; so that he can enter the state of ihram for Hajj from it. If he enters the state of ihram before the miqat, his Hajj is valid, but he is obligated to sacrifice an animal to compensate for his ritual, and it is to be slaughtered in Makkah and distributed among the poor of the Haram . And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
