Q: A person residing outside Makkah in the southern region has business in Makkah . When he leaves to go outside Saudi Arabia , he heads to Makkah to collect his belongings. If it becomes necessary for him to stay in Makkah for a day or two, should he enter Makkah in the state of ihram or not?
A : Whoever intends to enter Makkah for Hajj or 'Umrah must enter the state of ihram from the miqat he passes through. As for one who enters it for a visit, a need, or the like, and does not intend to perform the rites of pilgrimage, he is not required to enter the state of ihram. This is based on the saying of the Prophet (peace and blessings be upon him) when he designated the miqats:
and those (Mawaqit) are also meant for those who live at these (places) and for those too who come from without towards them for the sake of Hajj or 'Umraهن لهن ولمن أتى عليهن من غير أهلهن ممن أراد الحج والعمرة
Sahih Muslim 1181a
. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
