Fatwa No. ( 20839 )
Q: Is it obligatory for every heir to pay zakah on his share for the six years when he takes possession of it, or is it obligatory to pay zakah on the total amount before it is divided? We ask you to be kind enough to answer this issue in detail.
A: It is obligatory for every heir to pay zakah on his share of the inheritance if it reaches the nisab (minimum threshold for zakah) or more, either by itself or by adding it to other money or trade goods, for every past year since the death of the deceased, provided there is no legal impediment to distributing it among the heirs. If there is an impediment, the lunar year begins from the time of taking possession. The amount of zakah is one-quarter of a tenth, that is, two and a half percent.
...reaching the nisab (minimum threshold for zakah) or more, whether by itself or when combined with other currency or trade goods, for every past year since the death of the deceased, provided there is no legal impediment to distributing it among the heirs. If there is an impediment, the lunar year begins from the time of possession. The amount of zakah is one-quarter of a tenth, that is, two and a half percent. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
