Q: I have a farm, and this farm is in a town other than the town where I live. When the harvest came – the wheat harvest – I harvested the wheat and gathered it, then sent it to the silos. I kept a quantity of this wheat amounting to (400 bags) of wheat, and sometimes I kept (200 bags), and sometimes I kept (100 bags), to plant it in the coming year, and it is always like this. The question is: Is there zakah due on what we set aside and did not send to the silos, but kept to plant in the coming year, if Allah wills
the Exalted? If there is zakah due on it, is it permissible for me to pay its zakah in the town where I live, or must I pay its zakah in the town where the farm is? And is it permissible for me to pay its zakah to my relatives, given that among them are the weak and women?

A : First: If the situation is as you described, then it is obligatory for you to pay zakah on the wheat you set aside, and its ruling regarding zakah is the same as that of what you put into the silos. Second: Regarding transferring zakah from one town to another, it is permissible if there is a stronger benefit. So, if distributing it to the eligible recipients in the town where you live includes a stronger benefit than distributing it in the town where the farm is, then that is permissible. Third: As for paying zakah to poor and needy relatives, excluding direct ancestors and descendants, that is more preferable; because it is both charity and maintaining family ties. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
