Q: My son passed away, leaving behind two wives. One of them was divorced from him approximately two months before his death via a revocable divorce. He had four daughters from the divorced wife, three of whom are disabled. They have reached the age of maturity, and their disability is total; they cannot speak or move except to a very slight degree. Their mother is looking after them, and some benefactors give them charity. Is it permissible for their mother to take some of the charity from those benefactors? With
the knowledge that she is a weak woman and owns no money, and they have a sister in full health who is fifteen years old. Is it permissible for her to take from the maintenance provided by the benefactors for her sisters? Their grandfather has taken guardianship over them from the court, and he asks: If the disabled ones enter into care, is it permissible for me to take some of the charity for their benefit? And do they have the same ruling as minors?

A : If these disabled daughters do not have money sufficient for them, it is permissible for their guardian to take charity for them to the extent of their need and to spend it on them. It is not permissible for him to take anything from what was given to them, because it is specific to them. It is not permissible for the aforementioned sister to take anything from what was designated for them. If the state provides them with insurance sufficient for them through the care of the disabled, it is not permissible to take charity for them, due to the lack of need for it. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
