Q2: My wife was pregnant in the second month, and Ramadan began. After she had fasted for fifteen days, blood appeared that was not menstrual blood. It continued with her for a period of seven days, but she continued to pray and fast. After that, she miscarried and broke her fast for the rest of the month. Is her fasting before the miscarriage valid despite the bleeding, or does she have to make it up? Please give us a ruling, and may you be rewarded.
A2: The blood that came from the pregnant woman mentioned is blood of corruption, which is not taken into account. She did well by continuing to fast and pray, and her fasting and prayer before the miscarriage, given the circumstances described, are valid, and she does not have to make anything up. As for the rulings after the miscarriage, they vary according to the time of the miscarriage in any of the four stages of pregnancy, as follows: First: If the pregnancy is lost in the first two stages: the stage of the mixed nutfah from the two fluids, which is in the first forty days of the fluid’s attachment in the womb, and the stage of the ‘alaqah, which is the stage of its transformation into congealed blood in the second forty days up to a total of eighty days, then in this case, the loss of the nutfah or ‘alaqah entails none of the rulings, without any disagreement, and the woman continues in her fasting and prayer as if there had been no miscarriage.
Second: If the pregnancy is lost in the third stage, the stage of the mudghah – that is, a piece of flesh – in which its organs, form, shape, and appearance are determined, and this is in the third forty days, from eighty-one days up to a total of one hundred and twenty days, then it has two cases: 1 - That the mudghah has no apparent or hidden formation of a human being, and the midwives do not testify that it is the beginning of a human being. In this case, the ruling on the loss of this mudghah is the same as its loss in the first two stages; none of the rulings apply to it. 2 - That the mudghah is complete in the form of a human being, or has an apparent formation of human creation: a hand or a leg or the like, or a hidden formation, or the midwives testify that it is the beginning of a human being. In this case, the ruling on the loss of the mudghah is that post-natal bleeding (nifas) and the end of the waiting period (‘iddah) apply to it. Third: If the pregnancy is lost in the fourth stage, that is, after the blowing of the soul, which is from the beginning of the fifth month, from one hundred and twenty-one days of pregnancy onward, then it has two cases: 1 - That it does not cry out with a wail. In this case, it has the rulings of the second case of the mudghah mentioned previously, with the addition that it is washed, shrouded, prayed over, named, and a sacrifice is made for it.
2 - That it cries out with a wail. In this case, it has the full rulings of a newborn, including what was in the previous case, with the addition here that it owns wealth through bequest and inheritance; it inherits and is inherited from, and so on. And Allah knows best. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
