Q: I am the legal guardian of my brothers and my father’s mother (may Allah have mercy on her), and I distributed the inheritance in the Sharia-compliant manner, praise be to Allah. There is an annual income of 27,600 riyals (twenty-seven thousand and six hundred) on the first of Sha'ban every year. I consulted one of the scholars of the Ifta’ department regarding the distribution of this annual amount among my grandmother and my brothers, and he informed me that the amount should be distributed equally among them. His ruling, may Allah guide him, was incorrect for me. On Thursday, 25/4/1421 AH, while I was listening to the program *Dunya wa Din*, which hosts
distinguished and virtuous scholars, a man raised the same question to them, and they informed him that the amount should be distributed such that the male’s share is equal to that of two females. I have distributed this amount equally for three years, namely 1418 AH, 1419 AH, and 1420 AH. I am now confused about my situation, hoping that you will clarify how the amount is distributed after the death of the person, and how to handle what I previously distributed. I hope for your guidance and clarification of this matter.

A: If the property is an endowment (waqf), the division is according to the stipulation of the endower that aligns with the Sharia-compliant purpose. If it is the property of their deceased, the division of the income is according to the Sharia-compliant inheritance shares for each heir. You must rectify what you missed in the past years by returning to those who took more than their share the amounts that were deducted from the rights of those who were shortchanged, unless the rightful owners waive their rights. You should continue in the coming years with the correct division, whether it is an endowment or an inheritance. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
