Q1: A person found five hundred riyals dropped in a street empty of passersby, so he kept it with him until its owner comes and asks about it, but no one came to ask about it, and it has been with him for a month and a half. What should he do with it; should he take it, or take half of it and give the other half in charity on behalf of the owner’s liability to the poor and needy, or put it in the public treasury? And what is the ruling on one who finds a sum of money in Makkah al-Mukarramah or outside it, such as al-Ta’if or Jeddah?
Volume 1: If a person finds a sum of money dropped in the street, he may take it if he wishes, identify it by its distinguishing marks, and call out for it in public gatherings for one year, or announce it in the newspapers. If its owner comes and describes its distinguishing marks, he hands it over to him. This is based on the saying of the Prophet (peace and blessings be upon him) when he was asked about lost property: It is agreed upon by al-Bukhari and Muslim.
And whenever its owner comes one day and identifies its characteristics, he should hand it over to him, excluding its increase that occurred after the year, for that belongs to the finder because it resulted while it was in his ownership. The identification of it for a period of one year by calling out and announcing in the newspapers twice or three times each month is for lost property other than that of Makkah . As for lost property of Makkah , it is not owned and it is not permissible to take it except for one who knows it permanently; based on his saying (peace and blessings be upon him):Sunan Abi Dawud 2017Sahih (Al-Albani) . And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
