Fatwa number ( 15719 )

Q: On one occasion, about 15 years ago or more, I was at a neighbor’s house and found him on his deathbed. They took him to the hospital, and I found his wife sitting there with another woman beside her. We sat together, and the second woman said to the wife: “Take some of the husband’s money.” The wife said: “Will you expose my affair?” We told her: “No, never.” We did not know what to do. The wife then got up and took some money, the amount of which only Allah knows, though the wife may have known how much it was. After the husband’s death and the distribution of the estate, this amount taken from the estate did not appear, and we did not reveal it. It remained hidden until this day. I remembered this incident today, so I went to the wife and advised her to return the money or inform the heirs about it. However, she said: “I could not, and you will not be able to do it.” It is known that the second woman took some of that money, or perhaps all of it, and spent it on her needs. I heard and saw this, but I do not know what to do. The heirs are: the aforementioned wife, a son of hers, and a daughter of his from another wife who has passed away. What is the ruling in this case? What is upon me? What is upon the wife? What is upon
the second woman? And what should we do? Please inform us; may Allah reward you and may Allah reward you with good.

A: It is obligatory for the wife who took the money to repent to Allah the Exalted and to return the money she took to her husband’s heirs, especially the daughter from another wife. It is also obligatory for the woman who gave the advice to return the money to the heirs. It is obligatory for her and for anyone who knew and did not forbid it to repent to Allah, Mighty and Majestic. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
