Q: I had a sum of money with one of the foreign companies operating in Saudi Arabia, the amount of which was four thousand five hundred riyals (4500) in exchange for work with that company. I followed up with them several times with the intention of collecting that amount, but they made excuses for not paying due to the absence of the engineer who had been in charge of the project, saying that he had been transferred to one of the other companies, and that I should demand the money from that engineer. Finally, I consulted the company manager, and he told me: "Ask for an amount of twenty thousand riyals, and we will provide you with the necessary documents to claim this amount. If you wish, you can give me some of this amount, or take it for yourself, since this company is unjust." He explained the documents and instructed them to pay the full amount. I received the full amount, which was twenty thousand riyals (20,000).
The question: Is the amount exceeding my entitlement lawful for me or not, and if I am not entitled to it, is it permissible to donate it to a charitable work or give it in charity to the needy? Please issue a ruling, may Allah reward you with good.
A: This mentioned action is not permissible; because it is lying and deception to consume wealth by false pretenses, and it is not lawful for the questioner to claim anything from the company other than the amount he is entitled to, due to the saying of Allah the Exalted:[An-Nisa 4:29] It is obligatory for you to return the amount exceeding your right to the company. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
