Fatwa No. (23424)
Q: A man died and left a bequest for his children to slaughter two camels on his behalf every year, and this was to be done at their old residence in Makkah al-Mukarramah , so that its meat could be distributed to the neighbors there out of his kindness to them. His children have now moved to Jeddah , and some of them are in al-Ta'if , and they find it difficult to carry out the bequest in Makkah . Is it permissible for them to carry it out at their current place of residence? May Allah reward you with good.
A: If the slaughter mentioned falls within the one-third of the deceased's estate, then it is obligatory
to carry it out in the place he specified. If the slaughter is from the questioner's own money, out of kindness to the deceased, then he may carry it out in whatever place he wishes. If it is difficult for you to carry out the execution of the bequest yourselves, there is no harm in appointing someone you trust in their honesty to carry out the bequest in the place mentioned by the bequeather.
