Q1: If the in-kind zakah offered by the person liable for it (camels, cows, or sheep) is emaciated and may not be of any benefit if slaughtered, and the person confirms that it is from the middle of his lawful wealth, is it to be taken from him, or is it to be returned to him and he asked to offer something better?
A1: The emaciated animal is not taken for zakah unless the entire wealth is of that kind; because zakah is a means of consolation, so the one paying zakah is not burdened with anything other than what he has; based on the hadith of Abu Bakr (may Allah be pleased with him) in the Sahih:
And do not send out in charity an old animal or one with a defect, or a male goat, unless the collector of zakah is willing to accept it.ولا يخرج في الصدقة هرمة ولا ذات عوار ولا تيس إلا أن يشاء المصدق
