Q: I was in one of the mosques and the midday prayer was being performed. The imam prayed four rak'ahs and then stood up for a fifth. The congregation recited tasbih, and this was done collectively, except that the imam had straightened up and completed his standing. One of the congregation spoke and said to the imam: "You are in the fifth rak'ah," and he completed that rak'ah. After that, a dispute arose between the imam and the congregation, with each defending his position. My question here is: A - Does the imam have the right to continue the rak'ah despite the congregation alerting him? B - Does the congregation member have the right to speak during the prayer as that person did? C - If someone was present and missed a rak'ah, is he considered to have completed the midday prayer because of this addition, or is it obligatory for him to make up a rak'ah?
A: First: If the imam stands up for a fifth rak'ah out of forgetfulness and the congregation alerts him
and he is not certain of his own state, it is obligatory for him to return. If he persists in the fifth rak'ah intentionally, his prayer and the prayer of those who followed him in that are invalid, if they knew it was the fifth. Second: Intentional speech during the prayer invalidates it, except in the case of the ignorant and the forgetful, for whom it does not invalidate the prayer according to the stronger opinion, due to the hadith of Mu'awiyah ibn al-Hakam, in which a man sneezed in his presence and he blessed him while he was in prayer. The Companions (may Allah be pleased with them) disapproved of this. When he finished his prayer, he came to the Prophet (peace and blessings be upon him) and asked him about it. The Prophet (peace and blessings be upon him) said to him:
Talking to persons is not fitting during the prayer, for it consists of glorifying Allah, declaring his Greatness. and recitation of the Qur'anإن هذه الصلاة لا يصلح فيها شيء من كلام الناس إنما هو التسبيح والتكبير، وقراءة القرآن

, and he did not order him to repeat the prayer. This indicates that speech in prayer does not invalidate it if the speaker is ignorant of the legal ruling. Likewise, speaking in prayer for its benefit does not invalidate it, due to the hadith of Dhu al-Yadayn. Third: If one is late in the prayer and the imam adds a fifth rak'ah, the latecomer does not count the extra rak'ah, and he must make up what he missed. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
