Praise be to Allah alone, and may prayers and peace be upon the one after whom there is no prophet. After that: The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the Grand Mufti from His Excellency the Director of the Department of Religious Awareness at King Faisal Hospital in the Holy Capital, containing the question which reads:
(I previously met with His Eminence the Shaykh: Abd al-Aziz ibn Baz (may Allah have mercy on him) for two consecutive days and asked him for a ruling on an important matter concerning Hajj and sick pilgrims. The sick patients in hospitals are taken up for Hajj with their treatments, food, and accompanying doctors and nurses. However, due to the congestion of vehicles, they are greatly delayed in returning to the hospital to complete their treatment. In some years, they did not arrive until the afternoon of the Day of 'Id. This caused the food and medicine to run out, the air conditioners in the cars to stop working, and the workers to flee to save their own lives from perishing. Some of the patients died, and the recovery of others was delayed and their illnesses worsened. His Eminence had issued a ruling that it is permissible for the sick to go via al-Maghmas directly to 'Arafah and return to Makkah without passing through Muzdalifah or Mina . We have adopted this ruling and have been acting upon it until now, praise be to Allah. However, we have not documented this ruling in writing, and we need this ruling in written form. Therefore, we request a ruling on this matter. We also reviewed the response of His Excellency the Minister of Health, number (11 5386) dated 23/1/1423 AH, which stated: (In reference to your letter number (2 9619) dated 20/12/1422 AH, and its attachment regarding what was sent to you by the Director of
the Department of Religious Awareness at King Faisal Hospital in Makkah al-Mukarramah regarding their taking sick pilgrims for Hajj, by transporting them from King Faisal Hospital in Makkah al-Mukarramah , as other hospitals in Makkah al-Mukarramah do, to 'Arafah and then returning them directly to Makkah al-Mukarramah without going to Muzdalifah or Mina .. And your request for information on the following inquiries: First: A detailed explanation of the method of taking sick pilgrims for Hajj at the hospitals of Makkah al-Mukarramah . Second: An explanation of the problems that confront these patients or those who take them for Hajj. Third: The extent of the benefit from medical evacuation aircraft in transporting these patients between the sacred sites. Fourth: Proposing solutions that the Ministry of Health sees for addressing this issue. It is my pleasure to inform your Eminence regarding the above inquiries as follows: 1- The method of taking sick pilgrims for Hajj at the hospitals of Makkah al-Mukarramah : The hospitalized patients whose medical condition requires supervision, medical follow-up, and the provision of treatment services are
transported in medical convoys consisting of buses and ambulances equipped for this purpose so that their lives are not exposed to danger. Some are designated for male patients and others for female patients, accompanied by nurses and specialized doctors. This medical convoy gathers from all hospitals in Makkah al-Mukarramah as well as from the hospitals located in the area of Mina . They are taken up to 'Arafah from after the afternoon prayer until sunset, and then returned to the hospitals without passing through Muzdalifah or Mina . 2- Regarding the problems that confront these patients or those who take them for Hajj, it is, praise and thanks be to Allah, that after adopting this method, no cases of patient death have occurred, especially during the past four years. In addition, there is good coordination with other entities, such as the General Security, to accompany the medical convoy in its movements? 3- Regarding the benefit from medical evacuation aircraft in transporting these patients between the sacred sites: Medical evacuation aircraft are used only in emergency and first-aid cases to save the patient's life.. In addition to their high cost and limited number
and capacity, as they are unable to transport but a small and limited number of patients with severe and critical medical conditions. 4- Regarding the solutions that the Ministry of Health sees for addressing this issue, the Ministry sees that the matter is successful from an organizational standpoint, and that the coordination efforts of all government entities participating in Hajj will, with the permission of Allah the Exalted, contribute to helping the pilgrims perform their rituals with ease and simplicity, especially since some of them have endured hardship and suffered greatly to reach the sacred lands to perform this obligatory duty. The Ministry affirms its desire to seek your Eminence's opinion from the Sharia perspective on the permissibility of not passing through the area of Muzdalifah and staying overnight in Mina , and other rulings related to Hajj such as: Tawaf, stoning the pillars, shaving or cutting the hair (exiting the state of Ihram).

After the Committee's study of the inquiry, it answered that the matter is as you mentioned in what His Eminence the Shaykh: Abd al-Aziz ibn Abd Allah ibn Baz, (may Allah have mercy on him), ruled, which is the exemption from staying overnight in Muzdalifah on the night of the tenth and staying overnight in Mina on the nights of the Days of Tashriq for sick patients who are unable to stay overnight; because their medical condition requires the promptness of transporting them from 'Arafah to the hospital to continue their treatment, and it is sufficient for them to
appoint someone from the pilgrims to stone the pillars on their behalf. As for Tawaf and Sa'y, if they cannot be carried for Tawaf and Sa'y, and they are unable to wait until they recover to perform Tawaf and Sa'y themselves or while being carried, then they appoint someone to perform Tawaf and Sa'y on their behalf.
