Q1: It is my custom to spend the last ten days of Ramadan in the Noble Makkah and to perform 'Umrah when I travel there from al-Ta'if. However, in a past year, I traveled there without performing 'Umrah, and I intended to perform 'Umrah at the end of the month from al-Tan'eem or al-Ja'ranah, and I actually did perform 'Umrah from there. My question now is: Do I owe anything for that 'Umrah which I intended to perform at the end of the month while I was in al-Ta'if, rather than when I descended from al-Ta'if? And if I do owe something but I am unable to do it, is it dropped from me, or is there a substitute? Knowing that we are one family consisting of 7 people.
A1: If you intended the 'Umrah from al-Ta'if but you entered the state of ihram from al-Tan'eem, then it is obligatory for you to pay a fidyah, which is slaughtering a sheep in Makkah that is acceptable as an 'Id sacrifice, to be distributed among the poor of the Haram; because you left off an obligatory part of the 'Umrah, which is entering ihram from the miqat of al-Ta'if, which is as-Sayl or Wadi Mahram, and whoever from
your family did what you did, he owes the same as you.
