Q: During last spring break, I took my family and children with the intention of visiting my sister in al-Ta'if , and to perform 'Umrah and seek medical treatment in Jeddah . This was the primary intention. What happened is that we stayed in al-Ta'if for one day, then we went to Jeddah , passing through Makkah without entering the state of ihram from al-Sail , as I believed there was no harm in that. So we postponed the 'Umrah until our return from Jeddah . Indeed, after we finished our business in Jeddah , we entered the state of ihram for 'Umrah, and we also forgot to pray the two rak'ahs after entering ihram. It was on my mind that there is a miqat between Jeddah and Makkah , but we did not find a miqat, so we continued until the Haram and performed the 'Umrah. Upon returning to work, I mentioned this to some of my teachers at the Institute of Islamic Studies, and they said that we owe a blood sacrifice, and that it was obligatory for us not to pass Makkah without performing the 'Umrah. I ask your Eminence to guide us to the truth and tell us what is required of us. May Allah preserve you.
A: It is obligatory for one who intends to perform 'Umrah and then passes the miqat to enter the state of ihram from it, and it is not permissible for him to pass it without entering ihram. Since you did not enter ihram from the miqat, it is obligatory for each of you to offer a blood sacrifice, which is the slaughter of a sheep that is acceptable for the 'Id sacrifice, to be slaughtered in the Noble Makkah and distributed among its poor, and you must not eat any of it. As for leaving the prayer of two rak'ahs after wearing the ihram garments, there is no blame on you for that.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his companions.
