Q: I have a matter concerning fasting and making up missed fasts. It is that on one of the last ten days of the blessed month of Ramadan in the year 1423 AH
I had intercourse with my wife while the mu'adhdhin was calling the adhan for the Fajr prayer , knowing that: 1- I was in a city other than the one I live in (I did not know the time of the adhan). 2- I had intended to finish the intercourse before the adhan ended, and that is what happened. 3- My wife was not willing, but I convinced her to finish the intercourse before the adhan, if Allah wills. 4- At the time of the intercourse, there was more than one mu'adhdhin calling the adhan at the same time. 5- I do not know if I broke my fast with this act. If I did break my fast, I ask you, may Allah reward you, to guide me to the correct path, and is there anything required of my wife?

A: If the adhan was at the time of the dawn (Fajr) breaking, then the questioner and his wife must make up that day, and each of them must pay the expiation (kaffarah), which is freeing a slave. If he does not find one, then fasting two consecutive months. If he cannot do that, then he must feed sixty poor people, giving each poor person half a sa' (a dry measure of about 3 kg) of food, which is approximately one and a half kilograms. However, if the adhan was before the dawn (Fajr) breaking and they finished their state before the dawn (Fajr) breaking, then nothing is required of them; because Allah has permitted intercourse, eating, and drinking until the dawn (Fajr) breaking.
