Q: We inform you that we are a group of colleagues at work, numbering (12 people), some of whom are from other regions in the Kingdom. We, the founders of the association, decided to establish a private association among ourselves under the name (Cooperative Financial Association), with conditions, clauses, and regulations that we alone established and chose. It has a treasurer and a management team consisting of the same individuals participating in the association, which serves as a reference for them when needed. Participation in this association was undertaken with full conviction, without any restrictions or coercion. The value of the subscription share was determined to be an amount of (2500 riyals), paid monthly—after receiving salaries—and deposited into the association’s dedicated account at one of the local banks. The duration of the association was set at (24 months), and the share and portion of each participating member
in the association is an amount of (60,000 riyals). This amount is handed over personally by the treasurer at the end of every two months, according to the order of each person in the association’s initial lottery (first, second, third... twelfth). After reviewing our method in this association, we hope you will kindly issue a fatwa and answer some questions from the participating individuals, who have experienced some confusion and doubt regarding the payment of zakah on the association’s money, particularly the person whose turn comes last in the association, i.e., the twelfth person according to the lottery. We inform you that all these answers to our questions will be kept attached within the association’s booklet to serve as a primary reference for everyone and to be utilized when needed. Our questions are as follows: 1- Is the amount that a person deposits monthly into the association during its validity period (2500 riyals) subject to zakah or not? 2- Is the amount that a person receives (60,000 riyals), which is his share and portion from the association every two months, subject to zakah or not? 3- Is the amount that the last person deposits (2500 riyals) for a period of twenty-three months subject to zakah or not?
4- Is the amount that the last person receives, which is his share and portion from the association (60,000 riyals), subject to zakah or not? 5- We hope you will kindly direct a noble word encouraging participation in the association. May Allah reward you with good.
A: The money a person pays into this association is subject to zakah if a lunar year passes over it. If he receives the full amount of the association, it is not subject to zakah unless a lunar year passes over it. As for what he contributed from this amount, its lunar year is the same as the lunar year of his money, and he pays its zakah at the end of his lunar year. It is permissible to advance the zakah of what has not yet completed its lunar year, just as the Prophet (peace and blessings be upon him) advanced the zakah of his uncle al-Abbas ibn Abd al-Muttalib (may Allah be pleased with him).
