The first question of Fatwa No. ( 20771 )
Q 1: Our organization, named (The Union of Muslim Youth of Kairouan Association), asks about the topic of combining the Maghrib and 'Isha' prayers , specifically the disagreement regarding the manner of combining them. The first group says: there is no dhikr between them, and they cite the hadith of 'Abdullah in al-Bukhari :
Narrated `Abdullah bin `Umar: "I saw Allah's Messenger (ﷺ) delaying the Maghrib prayer till he offered it along with the `Isha' prayer whenever he was in a hurry during the journey." Salim narrated, "Ibn `Umar used to do the same whenever he was in a hurry during the journey." And Salim added, "Ibn `Umar used to pray the Maghrib and `Isha' prayers together in Al-Muzdalifa." Salim said, "Ibn `Umar delayed the Maghrib prayer because at that time he heard the news of the death of his wife Safiya bint Abi `Ubaid. I said to him, 'The prayer (is due).' He said, 'Go on.' Again I said, 'The prayer (is due).' He said, 'Go on,' till we covered two or three miles. Then he got down, prayed and said, 'I saw the Prophet (ﷺ) praying in this way, whenever he was in a hurry during the journey.' `Abdullah (bin `Umar) added, "Whenever the Prophet was in a hurry, he used to delay the Maghrib prayer and then offer three rak`at (of the Maghrib) and perform Taslim, and after waiting for a short while, Iqama used to be pronounced for the `Isha' prayer when he would offer two rak`at and perform Taslim. He would never offer any optional prayer till the middle of the night (when he used to pray the Tahajjud)."رأيت النبي صلى الله عليه وسلم إذا أعجله السير يؤخر المغرب فيصليها ثلاثًا ثم يسلم ثم قلما يلبث حتى يقيم العشاء فيصليها ركعتين

... etc. The second group says: there is dhikr between them, and they cite the hadith of Abu Hurayrah in al-Bukhari as well:
The people of wealth have taken away the high ranksذهب أهل الدثور من الأموال بالدرجات العلا
... up to the words of the Prophet (peace and blessings be upon him):
Say "Subhana l-lah", "Al hamdu li l-lah" and "Allahu Akbar" thirty three times each after every (compulsory) prayer.تسبحون وتحمدون وتكبرون خلف كل صلاة ثلاثًا وثلاثين

. So which of us is correct?

A 1: If a Muslim needs to combine the two prayers for a legitimate religious excuse that permits combining, he should not separate the two combined prayers except with a brief interval, following the example of the Prophet (peace and blessings be upon him).
There is no contradiction between the two hadiths; because the first hadith specifies the second. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
