Q: In the blessed month of Ramadan, I and the citizen (A. R. M.) went to the Shari'ah court to establish a debt of (9,200) that I owed him. Half an hour before the session, Satan tempted us, and we wrote out a second check for (10,000), saying we would split it if a good person paid it off. We entered the presence of the honorable judge and asked him about this debt. We lied to Allah, then to the judge, and told him: it is for sheep. The judge believed us, and a check was issued for (19,200) riyals: (9,200) riyals were a real debt, and (10,000) riyals were not real. I regretted that and fear that a payment might come to me. Is the ten thousand lawful for us or forbidden? Please advise us.

It is obligatory for them to repent to Allah and seek forgiveness for what came from them. It is not permissible for them to take the ten thousand with which they lied. If they have already taken this amount, it is obligatory for them to return it to the party that gave it to them. Only the creditor among them is permitted to take the amount of the real debt that he has against his partner, provided that the debtor meets the conditions required for taking such a debt.
