Q: I hired a driver of Egyptian nationality, named (M. M. A. F), on a fixed monthly salary. He worked for several months on a refrigerator truck. I found him to be hardworking and wanted to help him by providing work beyond the monthly salary. So, I rented the truck to him for seven thousand riyals per month. He actually benefited from this for three months and twenty days. On the last day of Ramadan last year, 1413 AH, on the night of the 27th, he was involved in an accident and died on the spot. There was one passenger with him who was unharmed, and the car was completely destroyed. I did what was necessary regarding his body, informed his family, and they requested that his body be transported to Egypt . I carried out the necessary procedures and sent it at my expense. There remains a balance of the car rental fees owed to me. I ask for your permissibility regarding my religious responsibility toward this deceased man so that I may clear my conscience before Allah. This is what happened according to the traffic report, as the accident occurred near 'Afeef .
A: It is obligatory for you, regarding this deceased man, to deliver his entitlements that are in your possession to his legal representative, through the Shari'ah court, in order to clear your conscience and obtain a Shari'ah document from the court to that effect. As for the right you have against him, you have the choice: if you wish, you may forgive him, and if you wish, you may hold his family accountable for it through the court or through an intermediary between you two.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
