Q: A man is negligent in prayer and does not perform it at its time. He may combine two or more prayers in one time, or he may intentionally sleep a little before prayer, or he may hear the adhan and sleep until the time has passed. Does this sleep mean that the pen is lifted from him? What is the ruling on keeping the company of this person,
and eating, drinking, and speaking with him after he has been advised several times?

A: It is not permissible to delay the prayer from its time without a valid Islamic excuse, such as the intention to combine for one who is permitted to combine the two prayers. The one who intentionally takes the prayer out of its time has disobeyed Allah the Exalted and committed a great sin. It is obligatory to rebuke him, and it is obligatory for him to repent to Allah and perform the prayer at its time in congregation. If he persists in his action, it is not permissible to keep his company; he must be boycotted and avoided, and his case must be referred to the Muslim authority to take action against him. The sleep mentioned is not an excuse for leaving the prayer or delaying it from its time, because he intentionally slept at the time of prayer or near it. A group of scholars have held that he is a disbeliever if he intentionally delays the prayer from its time without a valid Islamic excuse, based on the saying of the Prophet (peace and blessings be upon him):
Between a man and disbelief and shirk (associating partners with Allah) is the abandonment of prayer.بين الرجل وبين الكفر والشرك ترك الصلاة
, narrated by the Imam Muslim in his (Sahih), and his saying (peace and blessings be upon him):
The covenant that distinguishes between us and them is prayer; so whoever leaves it, he has committed Kufr.العهد الذي بيننا وبينهم الصلاة، فمن تركها فقد كفر
