The questioner : She says: I performed Hajj at the Sacred House of Allah three times, and in each instance I was unable to perform the farewell circumambulation due to valid legal excuses. I traveled without performing it and did not offer a fidyah (ransom payment) at that time. Is my Hajj valid and accepted, or not? And does the Shari'ah require anything of me now that the time has passed, and what is it?

The Shaykh : Yes, the Hajj of one who does not perform the farewell circumambulation is valid, because the farewell circumambulation is separate from the Hajj. For this reason, it is not obligatory upon the residents of Makkah. If it were one of the obligatory acts of Hajj included within it, it would be obligatory upon the residents of Makkah. However, it is an independent obligation for everyone who wishes to leave Makkah, whether a pilgrim or one performing 'Umrah. If this questioner has valid legal excuses, and that is menstruation, then the farewell circumambulation is dropped from the menstruating woman, based on the statement of Ibn 'Abbas (may Allah be pleased with him and his father): "The people were commanded that their last act be at the House, except that it was made easier for the menstruating woman". Accordingly, your Hajj is valid, and nothing is required of you as long as the excuse is a valid legal excuse, which is menstruation, because the ruling has been made easier for you, and praise be to Allah.
