The Conditions in a Vow

Machine translationRead the Arabic original
Fatwa No. ( 20199 )
Q: My wife made a vow when our infant child was ill, saying: "If he is healed and recovers from the illness, she will take him to Makkah al-Mukarramah for 'Umrah, accompanied by his father, who is me ." She stipulated that no one from the family should be with her except me. Is it permissible for me to bring one of my older children to help me drive the car, given that our residence is more than 400 kilometers from Makkah? Please note that I have another wife who wishes to accompany us. Is it permissible to take her with us? And is the vow considered fulfilled if she went with the child, his mother, and all the family members for 'Umrah in Ramadan? This actually happened last Ramadan in 1418 AH, which was after the vow was made. Did the vow fall off because of this, or is it necessary to go again, accompanied only by the wife who made the vow and the child? Please explain the answer in detail.
May Allah reward you

A: It is obligatory for this woman to perform the 'Umrah she vowed, if she is able to do so; based on the saying of the Prophet (peace and blessings be upon him):
Whoever vows that he will be obedient to Allah, should remain obedient to Himمن نذر أن يطيع الله فليطعه
Sahih al-Bukhari 6696
. As for the conditions she stipulated, namely that she be accompanied by her husband and that no one from the family accompany her, they are not considered. If she performed the 'Umrah in Ramadan with the intention of the 'Umrah she vowed, then it is sufficient. Be aware that it is not recommended for anyone to make such a vow; based on the saying of the Prophet (peace and blessings be upon him):
Do not make vows, for a vow has no effect against fate; it is only from the miserly that it is a means by which something is extracted.لا تنذروا، فإن النذر لا يرد من قدر الله شيئًا، وإنما يستخرج به من البخيل
Mishkat al-Masabih 3426
, agreed upon by al-Bukhari and Muslim. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
