Q 2: Is it possible for any Muslim to declare a person a disbeliever if he sees that the person has committed a nullifier of the nullifiers of Islam ?
A 2: The people of the Sunnah and the community do not declare a disbeliever any person from the people of the Qiblah for a sin unless he considers it permissible, as the Khawarij and the Mu'tazilah do, except for one who intentionally abandons prayer, for he is a disbeliever even if he does not deny its obligation, according to the correct of the scholars' opinions, due to what came in the evidence regarding the disbelief of the one who abandons prayer. And they do not say that a sin does not harm with faith for one who commits it, as the Murji'ah do. The people of the Qiblah are those about whom the Prophet (peace and blessings be upon him) said:
Whoever prays our prayer, faces our Qiblah, and eats our slaughtered meat, is a Muslim, having what we have and upon him what is upon usمن صلى صلاتنا، واستقبل قبلتنا، وأكل ذبيحتنا، فهو المسلم، له ما لنا وعليه ما علينا
It was narrated by al-Bukhari and others from the hadith of Anas (may Allah be pleased with him). And they are the people of the Sunnah and the community who walk upon the methodology of the Messenger of Allah (peace and blessings be upon him) and his Companions (may Allah be pleased with them) and those who follow them with excellence. But one who commits a nullifier of the nullifiers of Islam is a disbeliever, such as one who calls for aid from the dead or slaughters for them or curses Allah and His Messenger or mocks the religion and the like of that, as the scholars clarified in the chapter on the ruling of the apostate. And the people of the Sunnah do not testify that a specific person is from the people of the threat and that he is a disbeliever except with a matter with which testimony is permissible, for it is among the greatest of transgression to testify against a specific person that Allah will not forgive him and will not have mercy on him, and a severe threat has come regarding this.
And it is obligatory for the Muslim to pay attention to this great chapter, and to strive for safety, and to refrain from what does not concern him. And in (the two Sahihs) from Ibn Umar (may Allah be pleased with them both) he said: The Messenger of Allah (peace and blessings be upon him) said:
When a person calls his brother (in Islam) a disbeliever, one of them will certainly deserve the title. If the addressee is so as he has asserted, the disbelief of the man is confirmed, but if it is untrue, then it will revert to him.إذا قال الرجل لأخيه يا كافر، فقد باء بها أحدهما، فإن كان كما قال وإلا رجعت عليه

. And in them from the hadith of Abu Dharr (may Allah be pleased with him) that he heard the Prophet (peace and blessings be upon him) say:
If somebody accuses another of disbelief or calls him the enemy of Allah, such an accusation will revert to him (the accuser) if the accused is innocent.من دعا رجلاً بالكفر أو قال: يا عدو الله، وليس كذلك إلا حار عليه

Meaning: it returns upon him. And in (Sahih Muslim ) from the hadith of Jundub ibn Abdullah (may Allah be pleased with him) he said: The Messenger of Allah (peace and blessings be upon him) said:
Once someone said: 'By Allah! Allah will not forgive such and such (a person).' Thereupon Allah, the Exalted and the Glorious, said: 'Who is he who takes an oath in My Name that I will not grant pardon to so-and-so? I have granted pardon to so-and-so and rendered your good deeds fruitlessقال رجل: والله لا يغفر الله لفلان. فقال الله عز وجل: من ذا الذي يتألى عليَّ أن لا أغفر لفلان، إني قد غفرت له وأحبطت عملك
Riyad as-Salihin 1576
. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
