Q: I am directing this question to your Eminence, hoping that Allah will guide you and inspire you with the correct answer. It is this: A group of people of opinion in a certain Islamic country, who have no lawful ruler, formed a committee to reconcile the two parties to settle disputes and conflicts that arise between two or more tribes. However, among the prevailing customs and traditions, they go to the wronged tribe or to all of them, carrying with them one or more heads of camels, cattle, or other livestock. When they arrive at the disputants, they slaughter them in their presence to appease their feelings. If they were to go with money, even if it were a large amount, the discord would not cease except by the aforementioned act, which is the slaughter. What is the ruling of the Shari'ah regarding this slaughter? And if it is forbidden, then
the members of this committee have purchased a camel for approximately forty-five thousand and made it a fine on every member of the committee, and some of the members are poor. They asked us, the expatriates, for assistance, knowing that they are ignorant of the ruling in this matter. Is it permissible for us to help them with the value of this camel mentioned above, and tell them that repeating this act is not permissible? We ask for a comprehensive answer.
A: Allah (Blessed and Exalted is He) commanded the people of faith to cooperate in righteousness and piety, and forbade them from cooperating in sin and aggression. Among this is His saying (peace and blessings be upon him):Sunan Abi Dawud 3222Sahih (Al-Albani) , and this is to abolish the matters of the pre-Islamic age of ignorance, which those who do as you do practice. It is well known that settling disputes and reconciling between Muslims is among the greatest types of righteousness and excellence. However, the aforementioned custom, which is the obligation to slaughter some of the livestock, and that this is the way of reconciliation and satisfying the disputing tribe, is a defective custom that is not permissible to do or to continue with; because it is a matter of the pre-Islamic age of ignorance, and because it imposes a matter on the servants that Allah and His Messenger (peace and blessings be upon him) did not impose. It may also be behind it a belief in slaughtering for other than Allah, making it a means to shirk (associating partners with Allah) with Allah the Exalted. Also, these obligations stir up hatred, enmity, and grudges among people. Based on this, it is obligatory to abandon these traditions and customs that contradict the pure Shari'ah.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
