The questioner : What is the ruling in the Shari'ah, in your view, O honorable Shaykh, regarding one who swears by Allah but does not carry out the matter for which he swore, and the ruling for one who seeks Allah's forgiveness in the very moment he swore?

The Shaykh : If a person swears to do something and does not do it, he owes an expiation, based on the saying of Allah the Exalted:
Allah will not impose blame upon you for what is meaningless in your oaths, but He will impose blame upon you for [breaking] what you intended of oaths. So its expiation is the feeding of ten needy people from the average of that which you feed your [own] families or clothing them or the freeing of a slave. But whoever cannot find [or afford it] - then a fast of three days [is required]. That is the expiation for oaths when you have sworn. But guard your oaths لا يُؤَاخِذُكُمُ اللَّهُ بِاللَّغْوِ فِي أَيْمَانِكُمْ وَلَكِنْ يُؤَاخِذُكُمْ بِمَا عَقَّدْتُمُ الأَيْمَانَ فَكَفَّارَتُهُ إِطْعَامُ عَشَرَةِ مَسَاكِينَ مِنْ أَوْسَطِ مَا تُطْعِمُونَ أَهْلِيكُمْ أَوْ كِسْوَتُهُمْ أَوْ تَحْرِيرُ رَقَبَةٍ فَمَنْ لَمْ يَجِدْ فَصِيَامُ ثَلاثَةِ أَيَّامٍ ذَلِكَ كَفَّارَةُ أَيْمَانِكُمْ إِذَا حَلَفْتُمْ وَاحْفَظُوا أَيْمَانَكُمْ
[Al-Ma'idah 5:89]
So if he swears to something and says, "By Allah, I will certainly do such and such," and does not do it, he owes this expiation: either freeing a slave, or feeding ten poor people from the middle of what he feeds his family, or clothing them. If he cannot find the means, he must fast for three consecutive days. It does not benefit him if he says "I seek Allah's forgiveness" after the oath. What benefits him is to say "if Allah wills". So if he swears to something and says, "if Allah wills," and does not fulfill his oath, he owes nothing. If he says, "By Allah, I will certainly do such and such, if Allah wills," and does not do it, he owes no expiation. This is how the Sunnah came from the Prophet (peace and blessings be upon him).
