Q: I have an elderly mother who is about 90 years old, blind, and unable to move. She has a son, other than me, who passed away in 1382 AH, and he left children with their mother. She swore by Allah that she would not leave their house except to go to the cemetery, but they moved her from the house she was in to another place , and it is difficult for her if she stays there. I took her to my house because there was no one in that house, and she keeps reminding me all the time of the oath she made. She had left the house about four years ago, and she is still
repeating it and asking for a ruling. Should I leave my house and go with her to that house and leave my children, or is there something else she has to do?
A: If the situation is as described regarding the oath, she is not sinful for leaving that house after they left it; because it appears her intention was to stay with her son’s children there, following them, and they are the ones who left it with their mother and left her in it. Accordingly, she owes no expiation for an oath for leaving it, and she is not required to return to it. If her intention with the oath was other than what was mentioned, the questioner should clarify this so we can answer him according to her intention. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
