Fatwa number ( 12656 )
Q: My maternal grandfather (may Allah have mercy on him) forced my mother to marry her cousin according to Bedouin customs. This was forty years (40) ago, and he actually married her to him by force. After a while, he divorced her after she had given birth to only one daughter. When she returned to her father, she found all kinds of misfortunes, including beatings, herding sheep all day long, and the tyranny of her aunt (her father’s wife). She suffered and was patient, nursing her daughter. The years went on and she remained in this bad state. So she vowed to Allah a vow, which was a camel in a state of fatar, if Allah granted her a sane, kind man who would embrace and protect her. And this actually happened, as my father (may Allah have mercy on him) married her, and she bore from him a number of sons and daughters who are now men and women. Does she have to fulfill the vow now?
A: It is obligatory for your mother to fulfill her vow, because it is a vow of obedience. It is established that the Prophet (peace and blessings be upon him) said:Sahih al-Bukhari 6696 So the mentioned camel is slaughtered and distributed among the poor and the needy. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
