Q 4: A man and his older brother each have a son. The older brother’s son is older than the younger brother’s son. When the older brother’s son was being weaned, the younger brother’s wife said that she had been sleeping, and then the older brother’s son came to her after weaning and suckled from her once. He was not hungry, and he was already weaned and three years old. Is it permissible for him to marry his paternal cousins, or are they forbidden to him because of the breastfeeding?
A 4: If the situation is as described, with one instance of breastfeeding and the child being three years old, then it is permissible for this child to marry the paternal cousins whose mothers he did not suckle from, as well as those whose mothers he did suckle from. This is because the breastfeeding that makes marriage forbidden is five or more suckles within the first two years. This is based on the saying of Allah the Exalted:
Mothers may breastfeed their children two complete years for whoever wishes to complete the nursing [period].وَالْوَالِدَاتُ يُرْضِعْنَ أَوْلادَهُنَّ حَوْلَيْنِ كَامِلَيْنِ لِمَنْ أَرَادَ أَنْ يُتِمَّ الرَّضَاعَةَ
[Al-Baqarah 2:233]
, and on what is established from the statement of Aisha (may Allah be pleased with her): “It used to be
among what was revealed in the Qur'an: 'Ten known suckles make marriage forbidden,' and then this was abrogated by: 'Five known suckles.' The Messenger of Allah (peace and blessings be upon him) passed away while the matter remained as such.” And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
