I am a married woman, and it happened that my father held a wedding party that included drumming and other forbidden things, so my husband and I agreed not to attend the wedding.

The questioner : She says: A married woman, and it happened that my father held a wedding party that included drumming and other forbidden things, so my husband and I agreed not to attend the wedding, and praise be to Allah, we did not attend. But after that, my father, incited by my uncle, prevented me from seeing my husband for a long time, and my father and my uncle demanded that my husband divorce me, but my husband refused the request. After they despaired of getting a divorce, my father asked my husband for a sum of money amounting to fifteen thousand riyals, so my husband paid that money in exchange for taking me. And I ask, O honorable...The Shaykh : What is the ruling on the actions of my father and my uncle? And what is the ruling on the money my father took?
The Shaykh : These are three issues:
The first issue: This questioner and her husband boycotted the party that contained the forbidden, and this is a good thing and a righteous deed. I ask Allah to reward them for it. And this is the obligatory duty of every believer to prioritize the obedience of Allah (Mighty and Majestic) over all obedience, and the pleasure of Allah over all pleasure, and to boycott sins and their people, even if they are the closest of relatives. This is one.
Second: Her father’s preventing her from her husband, incited by her uncle, is forbidden, and it is of the works of sorcerers, may Allah protect us. Allah the Exalted said:[Al-Baqarah 2:102] So whoever attempts to separate a man from his wife has in it a resemblance to the sorcerers, and his work resembles the work of the sorcerer, and this is forbidden for both of them.
And if talebearing, which is transferring words from one person to another to separate them, is among the major sins, then separating them by action is even greater. And the Prophet (peace and blessings be upon him) said:Sahih Muslim 105a So her father and her uncle must repent to Allah (Mighty and Majestic) from this great sin, and they must also seek forgiveness from the girl and ask for her pardon. If they do not do so, she will be a claimant against them on the Day of Resurrection and will take from their good deeds. This is two, and this second one includes that the father and the uncle repent from this separation and seek pardon from the girl.
The third issue: Taking the fifteen thousand dirhams from the husband is forbidden and is consuming wealth by wrongdoing. The husband did not give his father fifteen thousand for the sake of his eyes, nor out of willingness, but he was forced to do so to free his wife from captivity. So what the father took is forbidden, and it is obligatory for the father to immediately return the fifteen thousand dirhams to the husband.
If the father says: The husband gave it to me, we say: Yes, he gave it to you under compulsion to free his wife, and had it not been for this, he would not have given it to you.
And in the end, I advise the uncle and others of those who hold feasts in a forbidden manner, and I say: Is this the reward for the blessing that Allah facilitated the marriage for your son or daughter, that you bring in forbidden things from music or drums?! Or worse than that, that you film the party and display it to people as one of the commodities?! And worse than that, that you film it on video that shows the live image so that people circulate it and see this woman and her beauty, and this woman and her ugliness, and this woman and her height, and this woman and her shortness, Glory be to Allah! Is this to be in a Muslim community that believes in Allah and the Last Day?!
I warn this and its like from these forbidden things, and I say: Hold the feast according to what the Shari'ah brought, with a hand drum for the women with decent singing far from temptation. This is a dispensation allowed by the Shari'ah, even if it contains a type of play, but it is permitted for the occasion.
